Terms and Conditions — Residential Routine Maintenance & Repairs
Acknowledgement
By signing up for routine maintenance service, approving a quote, or otherwise authorizing service from Coquina Group Pool Service (“Company,” “we,” “us,” or “our”), you, the customer (“Customer,” “you,” or “your”), acknowledge that you are agreeing to a regularly scheduled cleaning service for your pool.You represent and agree that you are legally responsible for the real property at the address on which the pool is located. You authorize us to proceed with the recurring service, and you agree that you are legally responsible for payment.You acknowledge and agree that any verbal representation contrary to these Terms and Conditions and the terms of your routine maintenance service is non-binding and of no legal effect. These Terms and Conditions set forth the parameters of the service, including your responsibilities as the customer. Please read them carefully and in their entirety.References in these Terms and Conditions to your “pool” include any vessel associated with your pool, such as any spa, basin, or water feature.
Your Service
Scheduled Service
Routine pool maintenance is performed on a weekly service schedule and billed on a monthly basis. Monthly service pricing reflects the cost of maintaining your pool throughout the year on a regular weekly route and is not based on the number of visits in a specific calendar month.Your monthly rate accounts for operational scheduling adjustments, holidays, weather interruptions, and other factors that may impact weekly routes.Customers acknowledge that routine maintenance is an ongoing service designed to maintain water quality and equipment operation over time and that temporary water clarity issues may occur between visits due to environmental factors.
Route Scheduling and Service Day Adjustments
Pool service routes are scheduled to maximize efficiency, technician safety, and service reliability. The Company reserves the right to adjust service days, service routes, and technician assignments as necessary due to operational needs, staffing changes, route optimization, weather events, holidays, or the acquisition or restructuring of service routes. While we make reasonable efforts to maintain consistent service days, specific service days are not guaranteed and may change with notice to the customer. Customers acknowledge that route adjustments are a normal part of operating a professional pool service company and agree that such changes do not constitute a breach of service or grounds for cancellation or refund.
Service Time of Day
Pool service is scheduled by route and technician availability. Specific times of day for service cannot be guaranteed. Customers acknowledge that service may occur at different times of day depending on route scheduling, weather delays, technician availability, or other operational requirements.
Accessibility
You are responsible for ensuring your pool maintenance technician can access your pool on your day of service. Please secure pets, leave any neighborhood or pool gates unlocked (unless we have the combination or access code), and remove pool or equipment covers on your service day. Your pool maintenance technician will not remove a pool or equipment cover to perform service. If your pool is inaccessible (for example due to a locked gate, cover, local construction, or loose animals), your pool maintenance technician is not permitted to wait. Instead, the account will be marked as unserviceable and the technician will proceed to the next appointment. You acknowledge that you will not receive a refund or credit for service that could not be performed due to lack of access. We are not obligated to make a return visit, and any return visit may incur an additional fee.
Service Level
You understand and agree that you are signing up for the specified level of pool maintenance service that you selected and acknowledge that such level of service may not include certain desirable or advisable treatments or cleanings.
Routine maintenance service may include:
- Testing and balancing water chemistry
- Skimming debris
- Brushing pool surfaces
- Emptying skimmer and pump baskets
- Checking equipment operation
- Vacuuming when conditions allow
Certain service offerings may require additional care from you to achieve optimal results for your pool. Routine maintenance does not guarantee algae-free water at all times. Many factors can contribute to cloudy pool water, algae, or other issues arising between visits, including:
- Number of swimmers
- Age and condition of equipment
- Landscaping debris
- Weather events including wind, storms, or rain
- Environmental conditions
Rescheduling or Additional Service
Please notify the office ahead of your scheduled service day if you have an event that requires rescheduling your service or if you need additional service. Pool maintenance specialists’ routes are often fully scheduled and we may be unable to accommodate special requests. Additional visits or special services may incur additional charges.
Service Issues
If you have questions about or concerns with our service, please contact our office within 24 hours of your scheduled service. If we are not notified in a timely manner, we may be unable to determine the cause of any issue and cannot assume responsibility. We are not responsible for green or cloudy water caused by:
- Rain or storms
- Excessive debris
- Nonfunctioning equipment
- Pool water loss
- Extremely high chlorine demand due to usage or environment
Service Exceptions for Holidays and Weather
Service may be adjusted due to holidays, weather conditions, or operational safety concerns.
Holiday Schedule: Routine pool service may not occur during the week of Thanksgiving or the week of Christmas.
These scheduled closures are already factored into your monthly service rate and customers acknowledge that they will not receive credits or discounts during those months.
Weather Conditions: On windy days we may be unable to perform the vacuuming portion of your service due to visibility and safety concerns. On rainy or stormy days we may be unable to perform brushing, vacuuming, or debris removal. During lightning, severe storms, tropical storms, or hurricanes we may suspend service entirely for technician safety. No refunds or credits are issued for service limitations due to weather conditions.
Storm Debris, Hurricane Events, and Green Pool Recovery
Storms, hurricanes, and extreme weather events may significantly impact pool conditions. Pools experiencing excessive debris, algae growth, contamination, or abnormal chemical demand following storms may require additional cleaning services beyond routine maintenance.
Such services may include:
- Storm debris removal
- Green-to-clean treatments
- Multiple recovery visits
- Excess chemical treatments
These services may incur additional charges. Following hurricanes or major storm events, normal service routes may be delayed, suspended, or adjusted for safety and logistical reasons. Restoring pool water to normal operating conditions following severe weather may require multiple visits. Routine maintenance pricing does not include storm cleanup or green pool recovery services.
Post-Storm Service Suspension and Recovery Prioritization
Following hurricanes, tropical storms, or other severe weather events, normal service schedules may be suspended or significantly delayed due to safety concerns, road conditions, debris, staffing limitations, or other operational factors. Customers acknowledge that restoring normal service operations following major storm events may take several weeks depending on the severity of the event and the number of affected pools. During these periods, the Company may prioritize pools based on route logistics, safety conditions, and operational capacity. Routine maintenance pricing does not include major storm cleanup, green pool restoration, or extraordinary debris removal. Pools requiring significant recovery services following storms may require additional visits and may be subject to additional charges. Customers acknowledge that immediate restoration of pool conditions cannot be guaranteed following major weather events.
Your Pool and Equipment
Water Level
Unless specifically arranged otherwise, you are responsible for maintaining proper pool water level. For maintenance services to be performed effectively and for equipment to operate properly, the water level should be approximately at the middle of the skimmer intake opening or tile line. If water levels are too low, technicians may shut off equipment or suspend service to prevent damage. We are not responsible for damage caused by low water levels.
Risks of Pool Filling Service
If we agree to assist with filling or maintaining water levels, you acknowledge that there are inherent risks associated with such services including:
- Water overflow
- Hose or timer malfunction
- Excess water usage
- Slip-and-fall accidents
- Structural damage due to water intrusion or ground instability
You agree to assume such risks and acknowledge that we are not responsible for losses related to pool filling services.
Chemicals
You agree that you will not add chemicals to your pool without consulting us. Certain chemicals can react with other chemicals and may cause bodily harm or pool damage. We are not responsible for issues caused by chemicals added by homeowners or third parties.
Equipment Maintenance
Your pool must have adequately functioning equipment including pumps, filters, circulation systems, timers, and automation. You must run your filtration system long enough each day to properly circulate the entire volume of water. We are not responsible for equipment replacement costs due to age, weathering, manufacturer defects, or neglect. Older or malfunctioning equipment may increase chemical demand and may result in additional charges.
Billing
If you provide credit card or ACH payment information, you authorize us to charge that payment method for services rendered. Routine maintenance service is billed monthly in advance. Invoices not paid within 15 days of the invoice date may incur a late fee of up to 5% of the overdue balance. Returned checks may incur a $20 fee. Failure to maintain payment may result in suspension of service.
Repairs
Notification, Poolside Parts, and Minor Repairs
Routine maintenance may reveal minor repairs necessary for safe equipment operation. By authorizing service, customers preauthorize minor repair charges up to $150 for small parts or minor repairs required to maintain equipment operation. Repairs exceeding this amount will require approval.
Repair Service Calls
Repair services are separate from routine maintenance. If repairs are performed by third parties and we determine that the work creates unsafe conditions, we reserve the right to suspend service until the issue is corrected. Payment may be required prior to performing repair work.
Warranty Disclaimer
Equipment or parts installed as part of repairs may be subject to manufacturer warranties. Coquina Group Pool Service does not provide warranties beyond those offered by equipment manufacturers. Warranty work is subject to manufacturer policies, parts availability, and scheduling constraints.
General
These Terms and Conditions are governed by the laws of the State of Florida. You agree that all claims, disputes, and matters arising out of or relating to pool maintenance or repairs will be resolved through mediation or non-binding arbitration unless otherwise mutually agreed. In the event of default on payment, you agree to pay collection costs, interest, and legal fees associated with recovering unpaid balances. If any provision of these Terms and Conditions is deemed invalid, the remaining provisions shall remain in full force and effect.
Agreement
By approving a quote, scheduling service, or allowing service to be performed, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
